FORT MYERS, Fla. — A firefighter is suing the city over discrimination claiming the department refuses to promote him because he has only one eye.

ABC7.com reported that firefighter Bill Miller has been with the Fort Myers Fire Department for almost six years, but he says the department refuses to promote him because he only has one eye.

Miller lost his eye to cancer when he was 5-years-old and he says in 2010 the department started treating him differently, according to the report.

Miller's attorney argues that the chief is using national fire guidelines as an excuse to avoid promoting Miller.

"I just want a chance to compete. If those guys are better, let them win, but I want a chance to get in there," Miller said.

The fire department declined to comment, according to the report.
