Man Fired the Day After Racial Discrimination Complaint, Files Lawsuit


Bartholomew Booth is an African-American man who worked as a truck driver for Heckmann Water Resources Corp. in Texas. After noticing that management showed favor to his white counterparts, Booth complained about the alleged discrimination on Jan. 10, 2012, and was terminated the following day.

Booth hired Attorney Marjorie Murphy of The Murphy Law Practice in Houston to represent his racial discrimination lawsuit against his former employer. The lawsuit was filed on Jan. 18 in the Eastern District of Texas, Lufkin Division. Booth alleges the company violated his civil rights by committing discrimination and retaliation. He is seeking a permanent injunction stopping the defendant from further discrimination and an award of damages for back pay, reinstatement or front pay, loss of earnings, loss of earning capacity, loss of benefits, compensatory damages for pain and suffering, mental anguish and emotional distress, punitive damages, attorney’s fees, interest, and court costs.

Booth was hired as a truck driver by Bear Creek Environmental in Aug. 30, 2010, and transitioned to working for Heckmann Water Resources Corp. Booth claims he noticed that management spoke to African-American employees at Heckmann’s Appleby yard in a demeaning manner and they were subjected to different rules than whites and denied benefits and privileges.
